2. Applicability

2.1 These General Sales Conditions (“Conditions”) apply to all offers, quotations, orders, sales agreements, and deliveries of products and/or services provided by juniqua - be unique is a brand of Harlem Kitesurfing B.V. (“juniqua”, “we”, or “us”) to any customer (“Customer”).

2.2 By placing an order, the Customer accepts these Conditions.

2.3 Deviations from these Conditions are only valid if confirmed in writing by juniqua.

3. Offers and Agreements

3.1. All offers and quotations are non-binding unless explicitly stated otherwise.

3.2. An agreement is formed only when juniqua confirms the Customer’s order in writing or starts performance of the agreement.

3.3. juniqua reserves the right to refuse orders without giving reasons.

4. Order cancellations and/or changes

4.1 Orders placed at juniqua can only be changed or cancelled if a request for change or cancellation is issued to juniqua within two (2) hours after the order has been placed. To issue such request, the Customer should contact juniqua within the 2 hours via WhatsApp or phone at +31 6 251 24 344. Requests for cancellation or change of orders retrieved more than two (2) hours after placing the order risk not being processed in time to prevent the order from being shipped. In that case, the order can no longer be changed or cancelled, and the Customer can return the product under the terms of our return policy.

4.2. If an order has been placed with the wrong delivery address, the Customer should contact juniqua within two (2) hours after placing the order via WhatsApp or phone at +31 6 251 24 344. Failure to do so could lead to the order being sent to the wrong address. In such case, juniqua is not responsible for a possible loss of the order and/or for redirecting or retrieving the order.

5. Prices and Payment

5.1 All prices are in euros (EUR), including VAT, excluding shipping costs, and other applicable charges, unless stated otherwise.

5.2.juniqua reserves the right to change prices at any time. Confirmed orders remain at the agreed price.

5.3.Payment must be made in full prior to delivery unless otherwise agreed in writing.

5.4.In case of late payment, juniqua may charge statutory interest and suspend or cancel deliveries.

6. Delivery

6.1 Orders placed on working days before 13:00 CET will be shipped the same day. Orders placed after 13:00 will be shipped the next working day. These shipping times are indicative and not guaranteed unless explicitly agreed otherwise.

6.2 Delivery times found on juniqua’s website, communicated on order confirmations and/or by juniqua staff are indicative and not guaranteed unless explicitly agreed otherwise.

6.3 Risk passes to the Customer upon pick up of the good at juniqua or upon delivery of the goods to the specified address by the shipping carrier.

6.4 juniqua is not liable for delays caused by third parties or force majeure

6.5 In case a shipment cannot be delivered, the package is shipped back to juniqua. If this happens, the order will automatically be processed as a returning item. The order value (excluding shipping costs) will be refunded to the Customer.

6.6 If a package being delivered is damaged, the customer should refuse the delivery and contact juniqua immediately. If refusal of the package is no longer possible, the customer is advised to take photos of the damages BEFORE OPENING the package, and to take additional photos of each step in the process of carefully opening the package. Once opened, item(s) shall be carefully inspected for any signs of damage. If goods are damaged, the Customer should contact juniqua immediately.

7. Retention of Title

7.1 All delivered goods remain the property of juniqua until full payment is received.

7.2 The Customer is not allowed to resell, pledge, or otherwise encumber the goods before ownership has transferred.

8. Returns

8.1 Customers have a 30-day right of withdrawal for online purchases in accordance with EU consumer law.

8.2 Products must be returned unused, in original packaging with tags – if any – still connected, and in its original packaging. Return costs are at the Customer’s expense unless agreed otherwise. Returns can be initiated following the process found on juniqua’s website.

9. Warranty

9.1 In addition to the statutory warranty rights, juniqua offers a manufacturer’s warranty of 2 years from the date of purchase on all juniqua kites and boards. This warranty covers defects in materials and workmanship under normal, intended use. This warranty does not cover damage from improper use, wear and tear, or accidents. No additional manufacturer’s warranty is offered for apparel and accessories (e.g. T-shirts, pouches). However, statutory rights remain unaffected.

9.2 If a product is found to have a manufacturing fault (i.e. it is defective under normal use and proper care), and this fault is reported to juniqua by the original purchaser within the first 2 years after purchasing it, juniqua will repair, replace, or refund the product at its sole discretion. The decision to repair, replace, or refund a product is made by juniqua after receipt of the defective product. 

9.3 This warranty is limited to new products purchased from an authorized juniqua retailer or distributor, or from the juniqua website.

9.4 Not covered by this warranty is: • Damage caused by anything other than defects in materials or workmanship; • Use in commercial, rental, teaching or instructional programs or activities; • Damage caused by exposure to sunlight, improper handling, storage, or failure to follow our instructions; • Products classified as 2nd-hand; • Normal wear and tear, including scratches and fading; • Products repaired by another repair service.

9.5 Warranty claims can be initiated following the process found on juniqua’s website.

9.6 If a defect or damage of a product does not fall under the warranty offered by juniqua, and the product can be repaired, juniqua will offer to execute such repairs at the expense of the Customer. This expense could include labour, material(s) and shipping costs from and back to the Customer. Before executing the repairs, juniqua will seek agreement by the Customer for these expenses.

10. Repairs

10.1 juniqua offers a repair service for most of its gear. Requests for repair can be initiated following the process found on juniqua’s website.

10.2 The costs of repairs and related shipping costs are at the expense of the Customers.

11. Use and maintenance of products

11.1 Kite- and wingsurfing are dangerous activities. The Customer should be aware of these dangers. Participation in kitesurfing activities is at the Customer’s own risk.

11.2 The Customer must ensure appropriate insurance and meet local requirements when using juniqua’s products.

11.3 juniqua is not responsible for the usage of its products. The Customer accepts that the use of juniqua gear is at his/her own risk. juniqua is not responsible for inherent risks/dangers and hazards involved with the use of its products. Minors and others not able to assume this responsibility must be under the direct control of an experienced and responsible person when using our products.

11.4 Before using juniqua products, the Customer should seek qualified instructions and familiarize his/herself with its proper use, capabilities and limitations.

11.5 Products should not be modified in any way.

11.6 To make sure juniqua’s products remain in excellent condition, juniqua strongly advises to dry the gear before packing it. Gear that has been packed wet needs to be unpacked within 1-2 hours to prevent any degradation of the materials. Furthermore, juniqua advises to lubricate metal parts regularly.

11.7 Damaged gear must be repaired immediately.

11.8 Failure to comply with any of these recommendations can lead to irreversible damage to the products and to serious injury or death of the Customer.

12. Liability

12.1 juniqua is not liable for indirect, incidental, or consequential damages.

12.2 juniqua’s liability is limited to the amount paid for the relevant order.

13. Force Majeure

13.1 juniqua is not liable for non-performance caused by circumstances beyond its control, including natural disasters, strikes, war, pandemics, or supplier failures.

14. Privacy

14.1 juniqua processes personal data in accordance with the General Data Protection Regulation (GDPR). See our Privacy Policy for more information.

15. Governing Law and Disputes

15.1 These Conditions and any agreements are governed by Dutch law.

15.2 Disputes will be submitted to the competent court in the district of juniqua’s registered office, unless mandatory law prescribes otherwise.
